Award variation - expense allowances - consent orders issued


REASONS FOR DECISION

[1] On 11 August 2011, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, (the Act) to vary Tasmanian State Service Award and the Health and Human Services (Tasmanian State Service) Award.

[2] A hearing was conducted in Hobart on 24 August 2011.  At the hearing Mr K Grey appeared for MASSA.  Mr M Johnston appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) while Mr J Eddington appeared for the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA).

[3] Mr Grey explained that these applications sought to vary Meal Allowances and Travel Allowances consistent with ATO Determination TD2011/17.

[4] The application was supported by Mr Johnston and Mr Brown. Correspondence was received on 17 August 2011 advising that the Construction, Forestry, Mining and Energy Union (CFMEU) Tasmanian Branch supports the application.

[5] I am satisfied that the applications are consistent with the public interest requirements of the Act.

[6] The applications are granted and the Awards are varied operative from the beginning of the first pay period to commence on or after 24 August 2011.

[7] The orders reflecting this decision follow.
