REASONS FOR DECISION

[1] On 13 September 2011, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Nurses (Tasmanian Public Sector) Award.

[2] A hearing commenced in Hobart on 4 October 2011.  At the hearing Mr P Baker appeared for the Minister administering the State Service Act 2000. Ms A Stanislaus-Large appeared for the Australian Nursing Federation, Tasmanian Branch and Mr J Eddington appeared for the Health Services Union of Australia, Tasmania No 1 Branch.

[3] The parties explained that this application is part of an ongoing process arising out of the 2010 agreement aimed at consolidating and updating the Award provisions.

[4] This application includes a number of existing allowances which had been updated consistent with the August 2011 State Wage decision , together with a number of new allowances including re-drafted clauses.

[5] I am satisfied that the application is consistent with the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 4 October 2011.

[7] An order reflecting this decision follows.

[8] At the request of the parties this file will remain open pending further progress in the updating process.
