Award variation – special allowance - consent order issued – operative date ffpp on or after 31/10/11

REASONS FOR DECISION

[1] On 21 September 2011, an application was lodged by the Australian Education Union, Tasmanian Branch, (AEU) pursuant to s.23 of the Industrial Relations Act 1984, to vary the Teaching Service (Tasmanian Public Sector) Award. 

[2] The application sought to vary Part IV Clause 3 - Special Allowance to reflect the duties and responsibilities of an employee holding the Teacher-in-charge position at the Molesworth Environment Centre.

[3] A hearing was conducted in Hobart on Monday, 31 October 2011.  At the hearing Ms R Madsen appeared for the AEU.  Mr P Mazengarb of the Department of Education appeared for the Minister administering the State Service Act 2000.  Both of the above gave oral submissions in support of the application.

[4] I am satisfied that the variations are consistent with the public interest requirements of the Act. 

[5] The order reflecting this decision, with an operative date from the first full pay period to commence on or after 31 October 2011, will follow.
