DEPARTMENT OF EDUCATION TEACHER TRANSFER INDUSTRIAL AGREEMENT 2011

REASONS FOR DECISION

[1] On 3 October 2011, the Minister administering the State Service Act 2000 (MASSA) and the Australian Education Union, Tasmanian Branch (AEU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Department of Education Teacher Transfer Industrial Agreement 2011.

[2] A hearing was conducted in Hobart on Monday, 31 October 2011.  At the hearing Ms D Crespan and Mr M Watson of the Department of Education appeared for the MASSA.  Ms R Madsen appeared for the AEU. 

[3] Ms Crespan submitted that the agreement has resulted from lengthy negotiations between both parties and that the Teacher Transfer Policy remains largely unchanged with some modifications to the transfer point structure and the timing. 

[4] Ms Madsen endorsed the agreement.

[5] The agreement, to be known as the Department of Education Teacher Transfer Industrial Agreement 2011, is to be operative on and from 1 July 2011 and to remain in force until 30 June 2012.

[6] The agreement applies to all employees covered by the State Service Act in classifications contained in the Teaching Service (Tasmanian Public Sector) Award.

[7] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[8] Pursuant to s55(4) of the Act, the agreement is approved operative from 1 July 2011. 

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
