Award variation – Contract of Employment Clause - insert into Parental Leave Clause a new sub-clause ‘Keeping in touch day’ - consent order issued - operative date 31/10/11

REASONS FOR DECISION

[1] On 3 October 2011, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Health and Human Services (Tasmanian State Service) Award

[2] The application sought to vary the Contract of Employment Clause by deleting and replacing subclause (c) Notice of Termination by Employee and Employer and to insert into the Parental Leave Clause a new subclause titled ‘Keeping in touch day’ in order to reflect the National Employment Standard.

[3] A hearing was conducted in Hobart on Monday, 31 October 2011.  At the hearing Mr T Kleyn appeared for MASSA.  Mr J Eddington appeared for the Health Services Union of Australia, Tasmania No 1 Branch (HSUA). Mr T Kleyn outlined the reasons for the variation and Mr J Eddington consented to the application.

[4] I am satisfied that the variations are consistent with the public interest requirements of the Act. 

[5] The order reflecting this decision, with an operative date from 31 October 2011, will follow.
