RECOMMENDATION


[1] On 5 October 2011 Yvonne Reed applied to the President, pursuant to s.29(1) of the Industrial Relations Act 1984 for a hearing before a Commissioner in respect of an industrial dispute with the Minister administering the State Service Act 2000/Department of Health and Human Services/Royal Hobart Hospital arising out a dispute in relation to termination of employment and breach of the Health and Human Services (Tasmanian State Service) Award.

[2] A hearing (conciliation conference) was conducted in Hobart on 25 October 2011.  Mr Mervin Reed appeared for the applicant.  Mr Phillip Baker and Ms Jane Fitton appeared for the respondent

[3] During the conference I met with the parties both separately and together and canvassed the issues in contention.

[4] In all the circumstances I strongly recommend that Mrs Reed be paid an amount equivalent to a Parental Leave entitlement (12 weeks’ pay) arising from Part IX Clause 2 of the Health and Human Services (Tasmanian State Service) Award. Such payment is in full settlement of all claims arising out of this application.

[5] Both parties indicated that they would accept this recommendation. Accordingly the file is now closed.
