Industrial dispute - implementation of bans against Tasmanian Ambulance Service and limitation of duties – order by consent issued

REASONS FOR DECISION


[1] On 22 November 2011, the Minister administering the State Service Act 2000 (the applicant) applied to the President, pursuant to Section 29(1) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with the Health Services Union of Australia, Tasmania No. 1 Branch.

[2] Following a conciliation conference with the parties on Tuesday 22 November 2011, the following order by consent is issued as the means of resolving this dispute:

Order by Consent

1. Effective immediately all bans and limitations on work performed and training will be lifted.

2. The Specialist Paramedic allowance of $3.20/hour currently paid on a per shift basis to a group of employees on a preservation basis will continue to be paid. Similarly the $20 per shift allowance paid in accordance with clause 15[b][vi] of the Ambulance Tasmania Agreement 2010[the Agreement] shall convert to $3.20 per hour. In both cases the allowance will be paid when rostered on or utilised on the helicopter service. i.e, the status quo as existed on 15 November 2011.

3. The allowance referred to in 2 above shall continue to be paid until a new agreement becomes operative, or until this dispute is resolved, whichever is the sooner.

4. There will be no impediment to normal operational recruitment and training. This includes the filling of existing vacancies and any vacancy which becomes routinely available in the future.

5. Save and except the subject matter of this order, the No Extra Claims commitment will be strictly observed.

6. The Commission will chair and facilitate a series of conferences aimed at finding a long term solution to the matter in dispute, namely, the Paramedic Specialist classification issue. The first meeting will is scheduled for 12 December 2011.
