DECISION

[1] On 13 September 2011, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Nurses (Tasmanian Public Sector) Award 2005.

[2] Mr Baker explained that this application was part of the ongoing process of reviewing and updating the award so as to reflect contemporary arrangements.  Clauses affected by this application are as follows:

Clause 2 – Shift Work

[3] Mr Baker noted that the only outstanding clauses related to ‘Hours of Work and Shift Work’.  It was anticipated that a further application in relation to these clauses would be lodged in the near future.

[4] Mr Eddington of Health Services Union of Australia, Tasmania No. 1 Branch (HSU1) and Ms Grosser of Australian Nursing Federation, Tasmanian Branch (ANF) consented to the application.

[5] I am satisfied that the application is consistent with the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 23 November 2012.

[7] The order reflecting this decision follows.
