Award variation – salaries and classification structure – public interest – order issued - operative date 20 February 2012

REASONS FOR DECISION

[1] This application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Governor of Tasmania Staff Award.

[2] A hearing was conducted in Hobart on 2 March 2012. At the hearing Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. Mr M Johnston appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr T Kleyn appeared for the Minister administering the State Service Act 2000 and Mr C Green appeared for Governor In Council.

[3] This application seeks to vary the Award by replacing the existing classification and salary structure with the provisions in the Tasmanian State Service Award. The application embraces Salaries, Classification Descriptors, Reference Framework, Summary of Difference between Bands and Band Descriptors. Minor modifications to reflect the nature of the employer have been included, together with consequential renumbering of subsequent clauses.

[4] The grant of an Award interest to The Australian Workers Union, Tasmania Branch (T13882 of 2012) has also been reflected in the application.

[5] Mr Flanagan explained that the grant of this application would bring the salaries and classification structure for staff of the Governor in line with wider State service. This he submitted was consistent with the public interest.

[6] The application was supported by Mr Johnston and not opposed by Mr Green and Mr Kleyn.

[7] I am satisfied that the application is consistent with the public interest requirements of the Act.

[8] The application is granted operative from 20 February 2012.

[9] An order reflecting this decision will follow.
