Industrial agreement variation – application – order by consent – operative date 27/3/11

REASONS FOR DECISION

[1] This application, lodged pursuant to s.59 of the Industrial Relations Act 1984 by the Minister administering the State Service Act 2000 and the Australian Education Union, Tasmanian Branch, was for the purpose of filing a variation to an industrial agreement with the Commission.

[2] A hearing was held in Hobart on Tuesday, 27 March 2012 at 9.30 am.

[3] The variations to the Polytechnic and Skills Institute Teaching Staff Industrial Agreement 2011 are to be operative from 27 March 2012.

[4] Ms C Davey, for the Australian Education Union, Tasmanian Branch, and Ms S Haas for the Minister administering the State Service Act 2000, presented submissions in support of the consent application.

[5] The parties advised that the application sought to vary the agreement by including in Clause 2 Application trade training centres.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest and the no disadvantage tests required by the Act, and I decide accordingly.

[7] An Order giving effect to the variation is attached.
