Award variation – State Service Accumulated Leave Scheme – consent matter – o/d ffpp on or after 15/11/12

DECISION

[1] On 8 November 2012, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Teaching Service (Tasmanian Public Sector) Award.

[2] At a hearing in Hobart on 15 November 2012, Mr P Mazengarb appeared for MASSA.  Ms R Madsen of the Australian Education Union, Tasmanian Branch (AEU) advised the Commission by correspondence that “…the AEU supports the employer’s application to vary the relevant award(s) to incorporate provisions relating to the State Service Accumulated Leave Scheme (SSALS).”

[3] Mr Mazengarb explained that that the purpose of the application was to remedy an oversight in that the State Service Accumulated Leave Scheme had not yet been included in the award.

[4] I am satisfied that the application is consistent with the public interest requirements of the Act.

[5] The application is granted operative from the first full pay period on or after 15 November 2012.

[6] The order reflecting this decision is attached.
