DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Minister administering the State Service Act 2000, (MASSA,) the Health Services Union of Australia, Tasmania No. 1 Branch, (HACSU,) and the Australian Nursing Federation, Tasmanian Branch, (ANF,) was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced in Hobart, Tasmania, on 14 June 2012 at 9.30 am.

[3] The agreement, to be known as the Caseload Midwifery Industrial Agreement 2012 is to be operative from the beginning of the first full pay period on or after 14 June 2012 and remain in force for a period of three years.  This is a new agreement modelled to provide flexibility to meet the care requirements of pre- and post-natal women and their babies.  Employee participation is voluntary and subject to the appropriate care framework and operational requirements.  The agreement will be reviewed towards its expiry date.

[4] Ms J Fitton, for MASSA, Ms R Knox, for the HACSU and Ms A Stanislaus-Large for the ANF presented submissions in support of their consent application.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with the public interest as required by the Act and that no party will be disadvantaged, and I decide accordingly.
