Industrial dispute – alleged refusal to recognise Nurses and Midwives (Tasmanian Public Sector) Heads of Agreement – community nurses – entry point for new appointments – status quo – principles of award construction – found no agreement in place – decline to make orders sought – recommendation – amendment issued to decision of 13/11/12

AMENDMENT

Following representations from the applicant the following amendment is issued, by way of clarification and certainty of intent, to my decision of 13 November 2012 in relation to the above matter:

Delete paragraph 62 and substitute the following:

“(62) Pursuant to s31 of the Act I decline to accept the applicant’s contended order and direct the parties to confer as soon as practicable with the view of completing the community settings review contemplated in the Heads of Agreement.  I so order.”
