Award variation – Clause 3 Scope of Part 1 – consent order issued


DECISION


[1] On 28 June 2012, an application was lodged by the Minister administering the State Service Act 2000 (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Health and Human Services (Tasmanian State Service) Award (Clause 3 – Scope of part 1 – APPLICATION AND OPERATION OF THE AWARD.)

[2] At the hearing on 29 June 2012, Mr P Baker appeared for MASSA with Ms E Jago.  Mr R Moore appeared for the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) and Mr M Johnston appeared for the The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU).

[3] Mr Baker explained that the purpose of this application was to incorporate into the Scope clause the Tasmanian Health Organisations covering the South, North and Northwest regions which are to come into effect from 1 July 2012.

[4] Both the HSUA and the CPSU consented to the application.

[5] I am satisfied that the application is consistent with the public interest requirements of the Act.

[6] The application is granted operative from 1 July 2012.

[7] The order reflecting this decision is attached.
