TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s23 application for award or variation of award

The Minister administering the State Service Act 2000
(T13921 of 2012)

DECISION

TASMANIAN STATE SERVICE AWARD

Deputy President Tim Abey
HOBART, 6 July 2012

Award variation – new Clause 10 of Part IV – Tasmanian Prison Service – Special Allowances – variation approved – ffpp on or after 5 July 2012

[1] On 28 June 2012, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tasmanian State Service Award by inserting a new Clause 10 – Tasmanian Prison Service – Special Allowances.

[2] At the hearing in Hobart on 5 July 2012, Mr P Baker appeared for MASSA and Mr M Johnston appeared for the Community and Public Sector (SPSFT) Inc.  Mr P Tullgren, for United Voice, Tasmanian Branch, advised the Commission that “…United Voice supports the application as proposed.”

[3] Mr Baker explained that the intent of this application is to transfer a number of ‘Special Allowances’ from previously registered industrial agreements into the Award.  This will ensure that the allowances are regularly reviewed as to quantum and form part of a genuine safety net on a sustainable basis.

[4] Apart from the allowance for the Tactical Response Group Commander, the remaining allowances already exist.

[5] Mr Johnston consented to the application.

[6] I am satisfied that the application is consistent with the public interest requirements of the Act.

[7] The application is granted operative from the beginning of the first pay period to commence on or after 5 July 2012.

[8] The order reflecting this decision is attached.
