Award variation – inclusion of Tasmanian Minimum Wage clause - consent matter – orders issued – operative date 31 July 2012

PARLIAMENTARY STAFF AWARD
GOVERNOR OF TASMANIA STAFF AWARD
POLICE AWARD

DECISION

[1]        On 10 July 2012 The Community and Public Sector (SPSFT) Inc. (CPSU) applied to the Commission to vary the Parliamentary Staff Award; on 12 July 2012 the Governor-in-Council applied to vary the Governor of Tasmania Staff Award; on 23 July 2012 the Police Association of Tasmania applied to vary the Police Award.  These applications, made pursuant to s23 of the Industrial Relations Act 1984, seek to insert a Minimum Wage clause consistent with the decision of the Full Bench in relation to public sector awards generally.[1]

[2]        At the hearing on 31 July 2012, Mr Kadziolka indicated that whilst the PAT supported the application in the interests of Award consistency, he did not envisage that it would have any practical effect in relation to the Police Award.  A similar view was expressed by the Commissioner of Police through correspondence dated 22 June 2012.

[3]        The CPSU, by correspondence dated 16 July 2012, indicated consent to the application in respect of the Governor of Tasmania Staff Award.

[4]        By correspondence dated 30 July 2012 the President of the Legislative Council and the Speaker of the House of Assembly consented to the application in respect of the Parliamentary Staff Award.

[5]        I am satisfied that the applications are consistent with the public interest requirements of the Act.

[6]        The applications are granted operative from 31 July 2012.

[7]        Orders reflecting this decision follow.
