TEACHING SERVICE (TASMANIAN PUBLIC SECTOR) SALARIES AND CONDITIONS OF EMPLOYMENT AGREEMENT 2012

Industrial agreement – application approved – operative date ffpp 1 March 2012 until 28 February 2014 – forwarded to Registrar for registration

DECISION

[1] On 6 August 2012, the Minister administering the State Service Act 2000 and the Australian Education Union, Tasmanian Branch (AEU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Teaching Service (Tasmanian Public Sector) Salaries and Conditions of Employment Agreement 2012.

[2] At the hearing on 9 August 2012 Mr M Watson appeared for the Minister administering the State Service Act 2000 with Ms S Haas and Mr C Lane appeared for the Australian Education Union

[3] Mr Watson outlined the changes which will occur as a consequence of this agreement. The changes include:

• Clause 8 Salaries: 2% increase from 1 March 2012 with a further 2% increase from 1 March 2013.
• Clause 9.3 School-Based Consultation.
• Clause 10 Planning, Preparation and Assessment.
• Clause 11.3 Facilities for Breast feeding and Expressing Milk.
• Clause 17 Additional Matters.

[4] Mr Lane submitted that the AEU totally supported the agreement whilst noting that in an improved financial environment, the union would be looking for a more favourable outcome in the future.

[5] Mr Lane also noted that a number of clauses could, from a practical point of view, only have effect prospectively.  They include:

• Clause 9.1 Consultation and Change
• Clause 9.3 School-Based Consultation
• Clause 10 Planning preparation and Assessment.
• Clause 11.3 Facilities for Breast Feeding and Expressing Milk

[6] Mr Lane gave an assurance that employees covered by the agreement would not as a consequence be disadvantaged

[7] I am satisfied that the agreement is consistent with the public interest requirements of the Act, and does not disadvantage the employees concerned.

[8] Pursuant to s55(4), the agreement is approved operative from the beginning of the first pay period to commence on or after 1 March 2012 and shall continue until 28 February 2014.

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
