Award variation – Appendix 11 Dental Officers - Clauses 2(c)(iii) 2(d)(iii) and 2(e)(iii) - Indicative Occupations deleted – consent matter – award varied – operative date 5/9/12

DECISION

[1]  On 29 August 2012, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Health and Human Services (Tasmanian State Service) Award.  This application seeks to delete reference to ‘Indicative Occupation’ at levels 4, 5 and 6 of Appendix 11 Dental Officers.

[2] At a hearing in Hobart on 5 September 2012 Mr P Baker appeared for MASSA. 

[3] Mr Baker explained that this variation was consistent with the progressive move from SES contracts to Award based regulation for the present incumbents.  Mr Baker assured the Commission that the individuals would not be disadvantaged as a consequence.

[4] The Unions with an interest in the Award did not oppose the application.

[5] I am satisfied that the application is consistent with the public interest requirements of the Act.

[6] The application is granted operative from 5 September 2012.

[7] The order reflecting this decision follows.
