TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s23 application for award or variation of award

The Minister administering the State Service Act 2000
(T13960 of 2012)

President Tim Abey
HOBART, 12 September 2012

Award variation – camp allowance – consent matter – operative date ffpp on or after 12/9/12

DECISION

[1] On 10 September 2012, an application was lodged by the Minister administering the State Service Act 2000, (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, (the Act) to vary the Tasmanian State Service Award with respect to Part IV Clause 1(a) Camp Allowance.

[2] At a hearing in Hobart on 12 September 2012 Mr P Baker appeared for MASSA.  Ms C Miller appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) and also for the Health Services Union of Australia, Tasmania No. 1 Branch.

[3] Mr Baker explained that this allowance had historically been treated as an expense related allowance.  However the parties had now agreed that it should be viewed as a work related allowance and adjusted accordingly.

[4] This application sought to vary the allowance to reflect adjustments to the Minimum Wage since 2008.  In future the allowance would be adjusted in the same manner as other work related allowances in the award.

[5] Ms Miller noted the change in approach and consented to the application.

[6] I am satisfied that the application is consistent with the public interest requirements of the Act.

[7] The application is granted and the award is varied operative from the beginning of the first pay period to commence on or after 12 September 2012.

[8] The order reflecting this decision follows.
