DECISION

On 25 May 2012 The Commission issued a decision and order in relation to this matter.

The decision stated:

“The file shall remain open for a period and the Commission is available to assist the parties in the implementation of this order if necessary.”

Subsequently a series of conferences has resulted in a position whereby an outcome, satisfactory to the parties, concerning the future employment of Mr Duke has been achieved.

I note that an appeal lodged by the Minister against this decision has since been withdrawn.

In the circumstances I refrain from further hearing this matter and close the file.
