Award variation – district allowances – consent matter – order issued – operative date ffpp on or after 7 November 2012

DECISION

[1] On 7 November 2012, an application was lodged by The Australian Workers Union, Tasmania Branch (AWU), pursuant to s.23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award with regard to Part IV - EXPENSE AND OTHER ALLOWANCES Clause 1 – Allowances (c) District.

[2] At a hearing in Hobart on 7 November 2012, Ms C Miller of The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. appeared for AWU with Mr B Dowker.  Mr R Flanagan of the AWU advised the Commission that:

“The union authorises Celeste Miller of the CPSU to represent the AWU in those proceedings.” 

[3] Mr K Grey appeared for the Minister administering the State Service Act 2000 (MASSA).

[4] The applicant explained that the district allowance had not been adjusted since 2008 and the purpose of the application was to achieve parity with allowances in other awards.

[5]  MASSA consented to the application.

[6] I am satisfied that the application is consistent with the public interest requirements of s36 of the Act.

[7] The application is granted operative from the first full pay period on or after 7 November 2012.

[8] An order reflecting this decision will follow.
