DECISION

[1] On 22 November 2012, the Minister administering the State Service Act 2000 and the Association of Professional Engineers, Scientists and Managers, Australia lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Department of Infrastructure, Energy and Resources Engineers (DIER) Industrial Agreement 2012.

[2] At the hearing on 27 November 2012 Mr B Charlton appeared for the Minister administering the State Service Act 2000 with Ms M Parker of the Department of Infrastructure Energy and Resources.

[3] Mr Charlton explained that this agreement is to replace the Department of Infrastructure, Energy and Resources, Roads and Traffic Engineers Industrial Agreement 2008 which nominally expired on 30 March 2012.

[4] The agreement provides for salary adjustments consistent with the State Service Wages Policy.  That is, salary increases of 2% from March 2012 and March 2013, together with provision for productivity increase of up to 0.5%subject to the satisfaction of certain criteria.

[5] The Commission has been advised that the agreement has been endorsed by a ballot of APESMA members and that employees will not be disadvantaged as a consequence.

[6] Pursuant to s.55 the agreement is approved operative from 27 November 2012 and shall remain in force until 31 March 2014.

[7]  The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
