Appeals against determinations by Commissioner Imlach in Matters TP1/9, TP1/8 and TP1/16, re award interest of the Hospital Employees Federation of Australia, Tasmania Branch (now the Health Services Union of Australia Tasmania No. 1 Branch) in the Keyboard and Office Assistants Award, the Hospital Scientists Award and the Welfare Workers Award respectively - appeals withdrawn

REASONS FOR DECISION

These appeals by the Tasmanian Public Service Association (now the State Public Services Federation Tasmania) were made pursuant to section 70 of the Act against determinations by Commissioner Imlach that the Hospital Employees Federation of Australia, Tasmania Branch (now the Health Services Union of Australia, Tasmania No. 1 Branch) had an interest in the Keyboard Employees and Office Assistants Award (TP1/9), the Hospital Scientists Award (TP1/8) and the Welfare Workers Award (TP1/16) and orders were issued varying the awards accordingly.

The appeal applications were lodged on 4 April 1990. On 11 April 1990 the Registrar advised, by notices in the Gazette, that the relevant provisions in the awards had been suspended until such time as the appeals had been determined.

Hearings listed for May 1990 were postponed at the request of the appellant. Further delays in listing the appeals were at the applicant's request.

Mr Vines, for the State Public Services Federation Tasmania (SPSFT), informed the Commission that recently there had been constructive discussions between the SPSFT and the Health Services Union of Australia (HSUA) in relation to the awards listed and that the parties were close to resolution. Therefore, Mr Vines said, the SPSFT wished to withdraw the appeals. In doing so Mr Vines added that he was doing so on the basis that it was the organisation's very firm preference that such issues should be determined by and between the unions affected.

Mr Kleyn for the HSUA supported the application to withdraw, and he said that his organization was ready to continue discussions with the SPSFT on this and other award matters.

The request to withdraw the three appeal applications is granted and orders to reflect the new position will follow.
