Appeal against decision of Commissioner

INTERIM DECISION

At the commencement of proceedings Mr Sertori requested leave to withdraw that part of the appeal grounds going to the proposed variation of the Right of Entry clause. He also requested an adjournment of the remainder of the application which relates to the variation of the Hours of Work clause. He advised the Commission that the parties were in the process of negotiating a settlement of this issue during discussions on structural efficiency.

Mr O'Brien supported the two requests.

In the circumstances the application was adjourned pending further advice from the parties. In granting leave to withdraw that part of the appeal dealing with the Right of Entry clause, we note the intention of the parties to expeditiously finalise the Hours of Work issue. Given that all matters subject to this appeal are stayed, we urge the parties to notify the Commission as quickly as possible as to the outcome of their negotiations.
