Appeal against an order handed down by Commissioner Gozzi on 2 November 1992 in matter T.3909 of 1992

REASONS FOR DECISION

These two matters were identically worded appeals made pursuant to Section 70(1)(c) of the Act against a decision of a Commissioner sitting alone and were joined for hearing.

More particularly the Electrical Trades Union of Australia, Tasmanian Branch (now Electrical, Electronic, Plumbing and Allied Workers Union of Australia) and the Metals and Engineering Workers Union (now Automotive, Food, Metals and Engineering Union) brought appeals against an item contained in a decision by Mr Commissioner Gozzi in matter T No 3909 of 1992 and concerning the Ferro Alloys Award.

When the matters were before us on 17 December 1992 it was the position of all parties that they required an adjournment, which was granted.

We have now received written advice from the unions that they no longer wish to pursue the matters before us.

In the circumstances it is our decision that both appeals be dismissed.
