Appeal - against decision of Deputy President Johnson in Matter T6668 of 1996, issued on 10.8.99 - Security Industry Award - alleged breaches of nominated clauses in respect of 12-hour shift agreements - order issued directing employer to comply with terms and conditions of award - application withdrawn - matter dismissed

REASONS FOR DECISION

On 31 August 1999 an appeal application was lodged by Wormald Australia Pty Ltd (now known as Tyco Australia Pty Ltd) against an order made by Deputy President Johnson in Matter T6668 of 1996, issued on 10 August 1999. The appeal application was referred to the Full Bench.

On 10 November 1999, correspondence was received from the Tasmanian Chamber of Commerce and Industry Limited in the following terms:

"RE: APPEAL AGAINST DECISION T6668 OF 1996

It is requested that the appeal lodged by the undersigned on behalf of the respondent in the above matter be withdrawn. The matter has been settled between the parties and as a consequence there is no need for the appeal to be heard."

In view of the above and pursuant to the provisions of section 21(2)(c) of the Act, the application is dismissed and the file is closed.
