This application by the Tasmanian Public Service Association sought the variation of nominated expense related allowances contained in various public sector awards (as set out in the attached schedule) by 6.82 per cent; being the movement in the eight capital cities consumer price index for the 12 months ended March 1989.

It has been accepted by the Commission as variously constituted from time to time, that the adjustment of expense related allowances in the manner requested, is permissible in accordance with part (a) Existing Allowances of the Allowances Principle.

Therefore on this occasion the various allowances, also set out in the attached schedule, will be increased by 6.82 per cent.

It should be noted that as Travelling Allowance has been varied in Matter T.1352 of 1989 it was deleted, by consent of the parties, from the allowances nominated to be adjusted.

The question of operative date was canvassed by the parties; the Association requesting 24 May 1989 when travelling and meal allowance matters (T.1352 of 1987) were before the Commission, albeit differently constituted at that time.

The Minister for Public Administration proposed that the operative date should be from when this decision issues.

We have given this matter careful consideration and have concluded that the adjustment should operate from the beginning of the first pay period to commence on or after the date of decision. Whilst we were not addressed on the question we consider that the cost of implementation of retrospective adjustment would considerably outweigh what, in most cases, will be a relatively small increase in the allowances.

The appropriate orders will issue in due course.

The reason for this is that the Advanced Education Service Award was the subject of Deputy President Robinson's decision in matter T.1352 of 1988 which dealt inter alia with the adjustment of expense related allowances.

In other words as the allowances in that award have already been adjusted no further variation is necessary at this time.
