Cancellation of registration

REASONS FOR DECISION

These Full Bench proceedings for the cancellation of registration of the Australasian Society of Engineers, Tasmanian Branch (ASE) resulted from an application by the Registrar, pursuant to Section 68(1)(a)(ii) of the Industrial Relations Act 1984, following a written request by the ASE.

The Registrar, Mr James submitted that the cancellation of the registration of the ASE was to facilitate the amalgamation in Tasmania of the ASE and the Federated Ironworkers' Association of Australia, Tasmanian Branch. The amalgamation of those employee organisations into the Federation of Industrial, Manufacturing and Engineering Employees was effected in the Australian Industrial Relations Commission1 operative from 15 July 1991.

Mr James also submitted the cancellation of the ASE's certificate of registration would allow him to give effect to the amalgamated employee organisations by altering the name of the FIA to the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch. Mr James said that the Rules of the new employee organisation do not comprehend an extension of eligibility beyond those currently applicable to the FIA and the ASE.

Having regard to the submissions of Mr James, supported by Ms Pavlic for the ASE and Mr Long for the FIA, we hereby cancel the registration of the Australasian Society of Engineers, Tasmanian Branch, operative from 15 July 1991.

We note the comments of Mr James that applications will be made in due course to vary awards to include the new name of the amalgamated employee organisations.
