Cancellation of registration

REASONS FOR DECISION

On 1 July 1992, in the jurisdiction of the Australian Industrial Relations Commission, the amalgamation of the Amalgamated Footwear and Textile Workers Union of Australia (the AFTWU) and the Clothing and Allied Trades Union of Australia (the CATU) came into effect.

On the same date, as a result of the amalgamation, the AFTWU's name was changed to the Textile, Clothing and Footwear Union of Australia (the TCFU) and the CATU deregistered.

In this jurisdiction, following a request from the TCFU, the Registrar, in order to effect the amalgamation in this State, applied for the cancellation of the registration of the Clothing and Allied Trades Union of Australia, Victorian Branch (CATU Victorian Branch) in accordance with Section 68(1)(a)(ii) of the Act.

At the hearing of the application the Registrar referred to the history of the amalgamation of the unions and sought the cancellation of the registration of the CATU Victorian Branch. The Registrar also foreshadowed that applications would follow in respect of change of name and award interest.

An operative date of 1 July 1992 was sought.

The CATU Victorian Branch supported the Registrar's application and submissions and also sought the cancellation operative from 1 July 1992.

The registration of the Clothing and Allied Trades Union of Australia, Victorian Branch is cancelled with effect from 1 July 1992.
