Cancellation of registration

REASONS FOR DECISION

These applications, which were heard together, were made by the Registrar under Section 68(1)(a)(ii) of the Act and sought the cancellation of the registration of The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch and The Operative Plasterers and Plaster Workers' Federation of Australia, Tasmanian Branch.

The Registrar advised that the applications arose out of union amalgamations which had occurred in the jurisdiction of the Australian Industrial Relations Commission (the AIRC).

An exhibit was produced which confirmed that, on the 23rd September, 1992, Deputy President Williams of the AIRC, pursuant to subsection 253Q(3)(c) of the Australian Industrial Relations Act 1988, deregistered The Federated Engine Drivers' and Firemen's Association of Australasia and The Operative Plasterers' and Plaster Workers' Federation of Australia in consequence of their amalgamation with the Construction Forestry Mining and Employees Union, thus creating the Construction, Forestry, Mining and Energy Union.

The Registrar produced an exhibit which illustrated graphically what had occurred and the resultant new Divisions formed in the Construction, Forestry, Mining and Energy Union.

For the practical purposes the Registrar sought for the cancellations to be made operative from the 23rd September, 1992.

It was noted that, following the cancellation of these registrations, the Construction Forestry Mining and Employees Union should present its Certificate of Registration to enable its name to be changed thereon and The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch and The Operative Plasterers and Plaster Workers' Federation of Australia, Tasmanian Branch should present their Certificates of Registration for cancellation.

The Construction Forestry Mining and Employees Union appeared and did not object to the applications.

We are satisfied the changes sought by these applications are in accordance with the requirements of the Act: the cancellations are hereby made operative from the 23rd September, 1992.

It will be left to individual members of the Commission to delete the names of The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch and The Operative Plasterers and Plaster Workers' Federation of Australia, Tasmanian Branch from the Parties and Persons Bound clauses of the awards in which they appear.
