Pursuant to Section 21 (1) and 21 (2) of the Act, the Commission as presently constituted directs the President to preside over such hearings or conferences and do all such things as he considers necessary for the purpose of preparing a report to this Bench on the following matters arising out of the unresolved issues raised by these applications.

Those matters are:

1. The question of development of classification standards and whether or not those standards should form part or be read in conjunction with awards relating to State employees.

2. Whether or not the Tasmanian Trades and Labor Council should be cited as a party to awards relating to State employees.

3. Whether or not qualifications held by certain employees should be deemed by the Commissioner for Public Employment to be equivalent to award requirements or to those qualifications requested by a controlling authority.

4. The definition of temporary employee and such other issues that arise therefrom.

5. Correct application of the Commission's test case decision regarding scope of awards and identification of parties and persons bound thereto.

6. Such other matters as may be relevant to the foregoing.

The President is authorised to present his report in the form of an interim report to be followed later by a final report, or a single report dealing with all issues referred to him.

The Commission would expect that the President's report(s) will be tabled as soon as practicable in order that the matters standing unresolved may be determined without delay.

In order to facilitate this enquiry, the President may have access to his Bench at any time should that need arise.
