Award variation - structural efficiency principle - annual leave provisions for seven day shift workers

REASONS FOR DECISION

In this matter the Health Services Union of Australia, Tasmania No. 1 Branch sought the variation of the Welfare and Voluntary Agencies Award to include in Clause 45 - Annual Leave, annual leave provisions for seven day shift workers.

The variation does no more than to clearly set out annual leave entitlements for those employees who work not less than ten Saturdays and ten Sundays during any one leave year. When that occurs the variation requested to be made provides for an additional seven consecutive days leave including non working days.

Additionally the variation sought to include in clause 45 pro rata accrual of additional leave on the basis of one days leave for each two months the employee is continuously engaged on the shift roster encompassing Saturday and Sunday work as outlined above.

The variation as requested to be made by the parties is endorsed as it is confirmation of existing arrangements. Also the variation does not contravene the Wage Fixing Principles or the public interest provisions of the Act.

The order operative from the first full pay period to commence on or after the date of this decision is attached.
