Interpretation - appropriate award classification

REASONS FOR DECISION

These applications, lodged by the Metals and Engineering Workers' Union (MEWU), sought to establish by interpretation which award should apply to the firm of Tas Hydraulics, and what rate of pay should attach to an employee engaged by the Company as a hydraulic service technician.

At the commencement of proceedings it was suggested that the hearing should adjourn into conference for the purpose of exploring the options available to resolve the issues between the MEWU and the Company.

During the conference representatives of the Department of Employment, Industrial Relations and Training advised that following an examination of a similar matter it had been determined that the appropriate award was the Automotive Industries Award. That advice was accepted by the parties.

It was further agreed that in order to establish the appropriate rate of pay for the work of a hydraulic service technician, who was required to service the Burnie district including the West Coast, two classifications in the Automotive Industries Award should be used. The parties were agreed that the rate of pay should be derived from the classifications of "Motor Mechanic" and "Commercial Traveller". It was noted that the classification of "Commercial Traveller Probationary", together with the "Motor Mechanic", was applicable for the first twelve months of employment. It was estimated that the employee's time was shared equally between the two classifications.

This decision records the matters agreed between the parties and establishes that the award to be applied to Tas Hydraulics is the Automotive Industries Award. Since the two applications to interpret the Metals and Engineering Industry Award and the Wholesale Trades Award were not pursued the files in question are now closed.
