COMMISSIONER R.K. GOZZI

HOBART, 10 April 1989

REASONS FOR DECISION

APPEARANCES:

For the Federated Miscellaneous
Workers Union of Australia,
Tasmanian Branch

- Mr K. O'Brien

For the Federated Engine Drivers'
and Firemen's Association of Australasia,
Tasmanian Branch

- Ms D. Moncrieff

For the Tasmanian Confederation
of Industries

- Mr M. Sertori

DATE AND PLACE OF HEARING:

6 April 1989   Hobart

The consent variations to the Laundrymens Award to include 3 per cent superannuation provisions is endorsed by the Commission.

The draft order submitted by Mr O'Brien, appearing for the Federated Miscellaneous Workers Union of Australia, Tasmanian Branch, to all intents and purposes complies with the Principle relating to superannuation.

I repeat my views on the question of exemptions.

I consider that as in most cases extensive periods of negotiation have occurred prior to superannuation matters coming to the Commission, then those who may contemplate seeking exemption from the negotiated and primarily consent provisions should do so at the time of the hearing.

I note that in this matter it is not anticipated that any employer will seek exemption, but nevertheless I am reluctant to extend that opportunity. As I have indicated the time to raise issues of that nature is during the course of the original proceedings.

My order in this matter, which includes consequential variations to the body of the award, is attached.

The operative date will be from the beginning of the first pay period to commence on or after 12 May 1989.
