This application seeks to vary the Independent Schools (Teachers) Tasmania Award by introducing provisions relating to occupational superannuation in accordance with the current Wage Fixation Principles.

The matter was presented to the Commission as one of consent.

The fundamental elements of the proposal are that it:

  1. Makes provision for contributions equalling 3% of employees' ordinary pay to be paid by the employer into a superannuation fund.

  2. Superannuation fund means "TASPLAN" or any other Occupational Superannuation Fund which conforms to the operational standards of the Superannuation Commission.

  3. A qualifying period of four (4) weeks employment applies.

  4. An exclusion of emergency teachers and part-time teachers who work less than five (5) hours per week.

The parties stressed that the agreed position was achieved following amicable discussions and in the absence of duress.

The proposal also follows closely earlier decisions of this Commission concerning the same subject. And in addition the general exemptions of certain categories of employers to the award as a whole continue to apply in respect of occupational superannuation.

Furthermore the proposed prospective date of effect in this matter is the same as already applies to a number of significant matters, including salary rates.

I am satisfied that the proposal put forward is consistent with the Wage Fixation Principles and does not offend public interest considerations stipulated by Section 36 of the Act.

Accordingly the claim is approved and the award will be amended accordingly.

OPERATIVE DATE

This variation shall take effect from the beginning of the first full pay period to commence on or after 1 July 1989.
