This application by the Tasmanian Confederation of Industries seeks the variation of the Miscellaneous Workers Award to include an exemptions clause to enable specified employers to contribute to other than Tasplan which is the nominated fund in the award.

The consent application contemplates exemptions for:

Northern Television (TNT9) Proprietary Limited -

The majority of employees of this employer are covered by a federal award. Occupational superannuation contributions are made to the Australian Retirement Fund (ARF). This fund was observed prior to the variation of this award for superannuation purposes.

In the circumstances the award will be varied to include ARF for this employer.

Dominic College -

I have acceded to the request of the parties to include the Archdiocese of Hobart Superannuation Fund in the award. This fund is already referred to in the Catholic Education Agreement and applies to employees subject to that document.

I understand, however, that Tasplan will still be available as an alternative fund for those employees who wish to exercise that choice.

Webster Limited -

The award only applies to two employees working as cleaners. The Webster Superannuation Fund has already been accepted by this Commission as constituted in these proceedings when dealing with the Produce Award.

The exemption is endorsed.

Tasmanian Teachers Federation -

The Tasmanian Teachers Federation Staff Superannuation Fund, as are all of the funds referred to in this decision, is also a complying fund meeting the conditions of the Occupational Superannuation Standards Act 1987.

In this case only one employee is subject to the award and it is therefore appropriate that this employee have his contributions paid into the Fund.

Federated Miscellaneous Workers Union of Australia, Tasmania Branch -

The Federated Miscellaneous Workers Union Staff Superannuation Plan was exempted in the Retail Trades Award. I endorse the exemption for this award also.

A consolidated order, operative from the first pay period to commence on or after 30 March 1989 will issue shortly. [See decision issued 18 September]
