Structural Efficiency Principle

REASONS FOR DECISION

In this matter the Federated Clerks Union of Australia, Tasmanian Branch, sought the variation of the Broadcasting and Television Award to reflect the second instalment structural efficiency adjustment.

Notwithstanding that several hearings have been conducted in this matter a satisfactory conclusion has not been reached. The parties still have to finalise their negotiations on a number of issues including which Divisions in the award, if any, should be removed. Also the award contains mostly outdated wage rates for classifications other than clerks. As indicated in an earlier decision1 of the Commission, the reason for this is that the award was not maintained prior to the commencement of operation of this Commission in January 1985.

I have been informed that the Tasmanian Trades and Labor Council has assisted in the preparation of a draft award which is intended to replace the existing award. However at this stage the draft award has not been agreed and further discussions will be required.

Having regard to the matters that still have to be resolved and because of the effluxion of time, the parties agreed with the Commission that it would be appropriate for these proceedings to be concluded.

Accordingly this file is closed.
