TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application to vary an award

Shop Distributive and Allied Employees' Association -
Tasmanian Branch

(T.3441 of 1991)

PRODUCE AWARD

COMMISSIONER P A IMLACH

28 October 1991

Award variation - employment type - trainee sales assistant

REASONS FOR DECISION

This application was made under Section 23 of the Act by the Shop Distributive and Allied Employees' Association - Tasmanian Branch (the SDAEA) for provisions relating to trainee sales assistants to be inserted in the produce Award (the Award).

The SDAEA's purpose in this application was to make the benefits of the Australian Traineeship System (ATS) available to sales assistants employed under the Award: other employees under the Award already have the system available to them.

The amendments sought, apart from including sales assistant under the ATS conditions already provided in the Award, included definitions, a wages prescription for a trainee sales assistant and preference in employment for trainees after the training is completed.

The Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch advised its support of the application.

The Tasmanian Confederation of Industries also supported the application.

As indicated at the hearing, I endorse this application on the basis that it has been agreed to by all parties and the benefits it sought to provide have been applying to others covered by the Award already.

The amendments sought will operate from the first full pay period commencing on or after 18 October 1991.

An order is attached.
