Award variation - making of a new award REASONS FOR DECISION This application by the Australian Municipal, Administrative, Clerical and Services Union (ASU) was for the inclusion in the Community Services Award, made by the Full Bench in matters T.2225 of 1989, T.2311 and T.2691 of 1990 in respect of Title and Scope operative from 22 January 1992, comprehensive conditions of employment and wage rate matters. It is a matter of record that this award making process has been protracted. However the stage has now been reached where the parties have made significant progress in their negotiations which should see the finalisation of the award in its entirety by February/March next year. An indication of the progress made is the consent documentation, Exhibit ASU2, which was presented as a draft order to give effect to a number of agreed conditions of employment matters. Having regard to the submissions of the parties I am satisfied that these particular matters comprising Annual Leave; Bereavement Leave; Blood Donors, Consultation - Procedures, Change, Redundancy; Dispute and Grievance Procedures; First Aid; Holidays With Pay; Leave Without Pay; Notice Board; Notification of Award; Parental Leave; Sick Leave; Telephone Allowance comply with the tests imposed by the Wage Fixing Principles. Also that the making of the award, albeit in a limited form in the context that other provisions will be included at a later date, is in the public interest. One further variation requested to be made by the parties relates to the Scope clause determined by the Full Bench in the matters I have referred to earlier. This simply relates to the alteration of the word "reference" to "referral" in clause 2(a)V(1). That variation which gives proper meaning to that particular subclause is endorsed. I congratulate the parties on the progress they have made which is reflected in the attached order, operative from the first full pay period to commence on or after the first full pay period to commence on or after 20 December 1993.
