REASONS FOR DECISION

This matter concerns an application by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch, to amend Clause 6 - Parties and Persons Bound clause of the Shipbuilders Award by deleting that organisation's previous name, i.e. the Construction, Forestry and Mining Employees Union, Tasmanian Branch and inserting the new name.

This name change has been registered by the Registrar following the formal amalgamation of the Construction, Forestry and Mining Employees Union, the Federated Engine Drivers' and Firemen's Association of Australasia and the Operative Plasterers and Plaster Workers' Federation of Australia and the approval given by the Australian Industrial Relations Commission effective on 23 September 1992.

In addition a Full Bench of this Commission decided on 18 December 19921 to grant the application of the Registrar for the cancellation of the registration of the Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch and the Operative Plasterers' and Plaster Workers' Federation of Australia, Tasmanian Branch.

Given the circumstances I am satisfied it would not be inconsistent with public interest requirements to grant the application.

I therefore decide to vary Clause 6 of the award by giving effect to the name change requested. At the same time it is opportune to delete the name of the Federated Engine Driver's and Firemens' Association of Australasia, Tasmanian Branch et al.

Order is attached.

Date of Operation

This variation to the award shall come into operation from 23 September 1992.
