REASONS FOR DECISION

Application was made by the Tasmanian Catholic Education Employees' Association to vary the Catholic Education Award to give effect to phased in adjustments to salaries and allowances as part of earlier "special case" proceedings1.

The matter was one of consent and the parties indicated that the adjustment sought would finalise movement in wage rates and allowances towards parity with those applying to teachers covered by the Teaching Service (Teachers) Award following the Full Bench Decision of 1 November 19922.

The Commission had earlier determined that a "special case" had been made out and that there had been a significant net addition to work requirements in accordance with the Work Value Changes Principle, and that in addition there had been actual implementation of efficiency measures designed to effect real gains in productivity.

Both parties gave assurances that to grant the application would be consistent with public interest criteria [Section 36 of the Act].

Since the matter is one of consent and the increases sought can be sustained on grounds of compliance with Wage Fixing Principles and public interest, the application to vary wages and allowances as detailed in exhibits presented at the hearing is granted and the award will be varied accordingly.

At the request of the parties the file will be kept open to permit the finalisation of negotiations in relation to certain other related award matters, at the conclusion of which a resumption of hearing may be requested.

Date of Operation

By consent, the present variations shall come into operation from the first full pay period to commence on or after 1 January 1994.
