HOBART, 26 April 1994

Industrial Dispute - underpayment of wages

FURTHER REASONS FOR DECISION

Further to my Reasons for Decision dated 11 April 1994 concerning a redundancy payment to be made to Mr Peter Hansen, the classification of Slaughterman (other than mutton chain) was incorrectly relied upon to determine the amount of redundancy payment due.

Mr Hansen was employed as a labourer and accordingly the classification rate for calculation purposes is $339.30 a week. Given that Mr Hansen was employed for 3 days a week only the amount of redundancy payment amounted to $1542.25. This payment is based on an hourly rate of $10.71 by 24 hours a week.

In the circumstances the quantum of the redundancy payment in my 11 April 1994 decision referred to above is to be disregarded and an amount of $1542.25 is to be paid to Mr Hansen, and I so order.
