SURVEYORS (PRIVATE INDUSTRY) AWARD

COMMISSIONER R K GOZZI

HOBART,  31 January 1994

Award variation ‑ safety net adjustment ‑ increase wage rate by $8.00 per week.

REASONS FOR DECISION

In this matter the Automotive, Metals and Engineering Union (AMEU) sought the variation of the Surveyors (Private Industry) Award to give effect to the $8.00 arbitrated safety net adjustment determined by the Full Bench in the 24 December 1993 State Wage Case decision.

Mr Baker for the AMEU submitted that the award had been subjected to the structural efficiency process and that a great deal of flexibility in working arrangements was now available to employers.  He indicated also that the minimum rates adjustment process was completed.  With regard to enterprise bargaining, Mr Baker informed the Commission that the surveying industry had reached very low employment levels and it would be a while yet before this improved.  Consequently there was little prospect of enterprise bargaining negotiations taking place at this time.   He indicated, however, that the AMEU would be involved in enterprise bargaining if and when the opportunity to do so presented itself.

Mr Clues for the Tasmanian Chamber of Commerce and Industry Limited (TCCI) supported the variation.  He also referred to the desirability of draft orders being exchanged prior to applications being heard by the Commission.   As indicated in the proceedings I support that approach.  However I am not prepared to hold up proceedings till that exchange takes place and indeed that was not requested of the Commission in this case.   Notwithstanding Mr Baker said that he would make a draft order available as soon as possible, within a day or two at the latest, and I record my appreciation for that co-operation.

Having regard to the foregoing the award will be varied in the manner requested operative from the first full pay period to commence on or after the date of this decision.

The order is attached.
