Award variation - wage rates - first minimum rates adjustment for professional scientists - operative 4.10.94 REASONS FOR DECISION This application by the Association of Professional Engineers, Scientists and Managers, Australia sought to vary the Professional Engineers and Scientists (Private Industry Award to include the first minimum rates adjustment for professional scientists. Mr Pyrke, representing the applicant organisation, informed the Commission that the application arose as a consequence of the Commission's decision of 14 March 19941 at which time approval was given to the phasing in of a salary structure for professional scientists. He said the present application represented the first adjustment in the four-step phasing in process. Mr Pyrke said it was a consent application, and sought an operative date of the first full pay period commencing on or after 4 October 1994. He submitted that the adjustment sought was consistent with the wage fixing principles and with public interest considerations. In confirming that it was a consent application, Mr Watson for the Tasmanian Chamber of Commerce and Industry Limited, reminded the Commission that whilst the process of minimum wage rate adjustments for professional engineers subject to the award had been completed, professional scientists had yet to receive adjustments. He agreed the intention was that the adjustments were to be in phased in in four steps, not less than six months apart. The proposed adjustments were read into transcript. He confirmed that the appropriate operative date for the first adjustment should be from the first full pay period commencing on or after 4 October 1994, this being six mo the after the classification structure had been inserted into the award2. I am satisfied that the variation conforms with the arrangements previously entered into between the parties and does not offend the wage fixing principles or the public interest. The award will be varied accordingly. The order is attached, operative from the first full pay period commencing on or after 4 October 1994.
