TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Tasmanian Salaried Medical Practitioners Society MEDICAL PRACTITIONERS (PUBLIC SECTOR) AWARD
Wage rates - State Wage Case November 1989 - Structural Efficiency Principle Second Stage Interim - Special Case - file closed REASONS FOR FINAL DECISION [Previous Decision] This application, lodged by the Tasmanian Salaried Medical Practitioners' Society (the Society) sought to vary the Medical Practitioners (Public Sector) Award to give effect to the second structural efficiency adjustment arising out of the State Wage Case of November 1989. This, it was said, was on an interim basis pending the outcome of Special Case proceedings consequential to the `arguable case' finding of the President in Anomalies Conference TA66 of 1990. On 5 October, 1990, the Commission handed down its Reasons for Interim Decision which granted the second structural efficiency adjustment to the award. That interim decision listed a number of agreed matters and issues that still required finallsation. It also acknowledged in that interim decision that there was an agreement between the parties that any wage increases arising out of the Special Case status granted to the application would be operative no earlier that 1 January 1991. On 5 January 1995 the Society lodged another application (T.5331 of 1995) to vary the Medical Practitioners (Public Sector) Award arising out of a complete review of the award undertaken by the parties. In correspondence dated 10 February 1995, the Society requested to withdraw application T.2652 of 1990 incorporating TA66 of 1990 as the new application (T.5331 of 1995) incorporated and superseded this application. Despite the considerable number of hearing days devoted to this application thus far nevertheless, to enable application T.5331 of 1995 to proceed and to eliminate any encumbrance I endorse the request of the applicant and the file will now be closed.
