REASONS FOR DECISION

These applications by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union were for variations to the Shipbuilders Award.

Application T5574, amongst other structural efficiency variations yet to be heard and determined, sought a new structure for classifications (a) to (d) in Division A of Clause 8, with consequent amendment of Clause 7, Definitions. Application T5576 sought the insertion of the second minimum rates adjustment in Division A of Clause 8, Wage Rates.

These applications had commenced before Commissioner Gozzi and were part-heard at his departure from the Commission. They resumed before me on 27 October 1995.

In presenting the agreed position of the parties following the earlier hearings before Commissioner Gozzi, Ms Thomas from the Tasmanian Chamber of Commerce and Industry Limited, submitted that Application T5576 sought the second increase for the minimum rates, the first increase having been implemented by the Commission's decision in 19921. At that time she said it had been agreed that the increases would be implemented in the following manner:

  • for trades classifications there would be four increases, six months apart,
  • for non-trades classifications it had been proposed there be six increases, six months apart.

The second increases were to be effective from 3 November 1995.

As to the other application, the parties informed the Commission that it was intended to seek to restructure the award in three stages, and the new classification structure was the first part of that process.

The parties tendered an agreed draft order.

I am satisfied that the applications and proposed order conform with the requirements of the guidelines of the Commission and comply with the provisions of the Act and that the new classification structure is a desirable improvement to the award. Accordingly the applications are approved and the award will be varied in the manner sought, operative from the first full pay period commencing on or after 3 November 1995.

The consent order [correction order] is attached.
