FURTHER REASONS FOR DECISION

This application was made jointly to the Acting Registrar under Section 55 of the Industrial Relations Act 1984 (the Act) by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union (the Union) and Brambles Australia Limited trading as Brambles Industrial Services of Cooee (the Company) for the filing of an industrial agreement.

The agreement was to be known as the Brambles Industrial Services - Tasmanian Equipment Servicing Agreement 1999 (the agreement): it was to operate from the first full pay period commencing on or after 1 July 1999, for a period of two years.

The application was initially heard on 24 January 2000 and rejected. The Union appealed through the Full Bench and the matter was returned to me for re-hearing.

At the second hearing, the Commission was advised by the Union that in exchange for wage increases of:

  • 2% from the first full pay period to commence on or after 1 October 1999;

  • 2% from the first full pay period to commence on or after 1 October 2000;

  • 1% plus an amount equivalent to 1% if certain key performance indicator targets are met 12 months after the commencement of the agreement;

  • 1% plus and amount equivalent to 1% upon achievement of agreed key performance indicator targets during the second year of the agreement,

a number of efficiencies and offsets had been agreed.

The key performance indicator targets relating to the extra payments were:

  • a 15% reduction in Workers Compensation costs;

  • maintenance of sick leave incidence at 1998-1999 levels, and

  • a 15% reduction in accident and property damage.

All these targets were the subject of a percentage hurdle.

State Wage Case increases or other award increases were excluded by the agreement and a redundancy provision was added.

The Union, in seeking approval of the agreement, submitted that it met the tests of the Principles of the Commission, especially the Structural Efficiency Principle and the public interest as specified in the Act.

The Tasmanian Chamber of Commerce and Industry Limited, appearing for the Company, supported the submissions of the Union and, in requesting approval of the agreement, also submitted that it complied with the Act and the Principles of the Commission.

I accept the submissions of the parties and the agreement is approved; it will be referred to the Acting Registrar, in accordance with Section 56 of the Act, for registration.
