MOBILE CRANE HIRE AWARD

REASONS FOR DECISION

[1] This is an application made pursuant to s.23 of the Industrial Relations Act 1984, by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU), on 19 September 2002.

[2] The application sought to vary expense related allowances contained in the Mobile Crane Hire Award. Specifically, the claim was to vary:

    1. Part III - Wages and Related Matters, Clause 2 - Fares, Travel and Accommodation, subclause (a) - Fares and Travel Allowance by increasing the allowance by the upward movement in the CPI for transportation, weight average of eight capital cities up to and including the June 2002 quarter, bringing the new rate to $13.30.

    2. Part III - Wages and Related Matters, Clause 2 - Fares, Travel and Accommodation, subclause (b) - Travel During Working Hours by increasing the allowance by the upward movement in the CPI for transportation, weight average of eight capital cities up to and including the June 2002 quarter, bringing the new rate to 0.73.

    3. Part III - Wages and Related Matters, Clause 2 - Fares, Travel and Accommodation, subclause (c) - Accommodation and Overnight Allowance by increasing the allowance by the upward movement in the CPI for travel and holiday accommodation in Australia up to and including the June 2002 quarter, bringing the new rate to $10.20.

    4. Part IV - Hours of Work, Shiftwork and Overtime, Clause 2 - Meal Breaks, subclause (b) - Meal Interval During Overtime by increasing the allowance by the upward movement in the CPI for food, meals out and takeaway, up to and including the June 2002 quarter, bringing the new rates to $9.60.

    5. Part VII - Occupational Health and Safety, Tools and Amenities, Clause 2 - Clothing and Protective Equipment, subclauses (b) and (d) by increasing the allowance by the upward movement in the CPI for eight capital cities weighted average, up to and including the June 2002 quarter, bringing the new rates to $44.60.

[3] Mr Mazengarb, for the Tasmanian Chamber of Commerce and Industry Limited, presented consent submissions in support of the application and requested the award be varied with a common operative date from the first full pay period to commence on or after 8 October 2002.

[4] This application is approved, as it is consistent with the Wage Fixing Principles.

[5] The Order giving effect to this decision attached. This Order also includes the Order arising out of T10444 of 2002.
