Award variation - safety net adjustment and work related allowances arising out of the 2001 and 2002 State Wage Case decisions - consent matter - application granted - award varied - operative ffpp 8 October 2002

REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984, was made by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU), on 19 September 2002.

[2] The application sought to vary the Mobile Crane Hire Award to reflect the safety net adjustments and increases in work related allowances arising out of the 2001 and 2002 State Wage Case decisions.

[3] The application was made with the consent of the parties, however, Mr Mazengarb, for the Tasmanian Chamber of Commerce and Industry Limited (TCCI), placed on record the unique circumstances which led the TCCI to consent to the application being operative from a common date, that is, the first full pay period to commence on or after 8 October 2002. He also emphasised that the CFMEU had agreed that consent on this occasion would not be used as precedence for future applications.

[4] Having considered the submissions, I am satisfied that the application should be approved, as it is consistent with the Wage Fixing Principles.

[5] The Order giving effect to this decision attached. This Order also includes the Order arising out of T10443 of 2002.
