REASONS FOR DECISION

[1] On 7 November 2002 applications were lodged by The Community and Public Sector Union (State Public Services Federation Tasmania) (CPSU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Community and Health Services (Public Sector) Award and the General Conditions of Employment Award, respectively.

[2] When these matters came on for hearing on 22 November 2002, Mr R Miller appeared for the CPSU, Mr T Jacobson appeared for the Health Services Union of Australia, Tasmania No 1 Branch and Mr R Hunt appeared for the Australian Education Union, Tasmanian Branch. Mr T Pearce appeared for the Minister administering the State Service Act 2000.

[3] These applications seek to adjust the Kilometreage Allowance to reflect movements in the CPI, "Transportation, Private Motoring" for Hobart, since the last adjustment in 2000.1

[4] Mr Miller explained that the adjustment, based on the September quarter 2002, had been calculated in accordance with a formula established by a Full Bench decision in T33 of 1985. Details of the calculation are contained in the files.

[5] Mr Jacobson and Mr Hunt supported the submissions of Mr Miller.

[6] Mr Pearce indicated consent to the applications.

[7] I am satisfied that the applications are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[8] The applications are granted operative from the beginning of the first pay period to commence on or after 22 November 2002.

[9] The Orders giving effect to this decision are attached.
